I thought that after a few incidents with tea and coffee that they'd lowered the water temperature but clearly not as that's horrible.
Certain teas and all coffee requires very hot water to extract properly. It's really not the sort of thing you ought to be drinking at all unless you're stationary, sat at a table, and have ample leg room to move quickly in case of spills.
Also, this is utter negligence:
Miller requested a cup of hot tea, which, according to the suit, was “presented to [him] filled to the brim, at an unsafely and unreasonably high temperature and without any form of a lid.”
