I bet unfortunately so that ne will not make it to trial. The rich and our fucked up justice system can't let him get off. I swear it will be the most watch trial of all time. Also there will be a movie based on this hero life someday. I hope he walks. Hope he can bring to light just how fucked up the healthcare industry is.

It was premeditated murder. The charge should be first degree. Second degree suggests he killed him without intent. I just wish he never got caught :(

In New York, for first degree the victim must be a cop, prison guard, first responder, judge or witness to a crime,
or
the murderer must be a burglar, contract killer, inmate for life, or terrorist.
There's a few other possibilities, but if you murder someone "normal" and it's your first time, generally it's second degree in New York.

First degree has a minimum sentence of 20 years and can get you sentenced to life without parole.
Second degree has a minimum sentence of 15 years and you have a chance for parole afterwards.
